Frequently Asked Questions

While we look forward to serving you, we understand that all legal needs are different and the advice here is general and in no way should be considered as direct counsel nor does it create any client-attorney bound relationship. Please call my office with your concerns so we can address your individual needs.

Divorce Tips

  1. Secure proper legal representation from an attorney who specializes in domestic law.
  2. Follow your attorney's advice.

Suggestions

  1. Terminate joint bank accounts
  2. Reserve marital property
  3. Consider temporarily suspending payments to IRA's and 401K's etc.
  4. DO NOT CANCEL OR SUSPEND ANY MEDICAL OR CAR INSURANCE COVERAGE OF EITHER SPOUSE OR CHILDREN
  5. Gather up financial records, tax returns, notes, deeds, title certificates and other legal papers and secure them
  6. DO NOT INVOLVE YOURSELF IN DOMESTIC DISPUTES.  DO NOT TOUCH, PUSH, HIT OR THREATEN YOUR PARTNER!  If the police are called one of you may be hand-cuffed and taken to jail.
  7. Cease any alcohol or non-prescription drug use immediately
  8. Obtain a restraining order from the County Court if you are in fear of physical violence
  9. If there are children, insulate the children from marital conflict.  Do not disparage the other party in front of a child.  Damage done can be insurmountable and takes years of theraphy with which to deal.  Be prepared to move to another residence if necessary and take all of your most valuable possessions with you when you leave, but DO NOT MOVE OUT OF THE MARITAL RESIDENCE UNLESS LEGALLY OR PHYSICALLY FORCED TO DO SO! Attempt to be civil and do not escalate the issues in your divorce action.  Keep a diary of events.
  10. OBTAIN AND KEEP RECEIPTS FOR ALL SUPPORT PAID FOR YOUR CHILDREN OR FOR MAINTENANCE TOWARDS THE MARTIAL HOME IF YOU LEAVE THE MARITAL HOME, MAKE ALL PAYMENTS BY MONEY ORDER OR CHECK.  NO CASH PAYMENTS WITHOUT SIGNED RECIEPTS.
